Land Disturbance/VSMP Permit
A permit is required for any land-disturbing activity which will disturb an area twenty-five hundred (2,500) square feet or greater, except as exempted by Chapter 37.1 Article VII – Soil Removal and Other Land Disturbing Activities in the Newport News Code of Ordinances. In some cases issuance of a Construction General Permit (CGP) is required per the Virginia Stormwater Management Program (VSMP). Land disturbance permit applications are submitted online. Requirements
In general, land disturbance permit applications must include the following items either electronically attached to the application or delivered/mailed to the Permit office:
- A plan showing proposed Erosion and Sediment Control measures for the land-disturbing activity. In some cases a plan will have already been approved by the Environmental Services Division of the Department of Engineering during the Development Services plan review process.
- A copy of the card/certificate for the Virginia Department of Environmental Quality (DEQ) certified responsible land disturber.
Projects may require additional documents not mentioned above based on the size and type of activity. These documents may include a refundable Soil Removal and Disturbance Bond, a VSMP/VPDES Registration Statement form, an Agreement In Lieu of Plan form, etc. If you have any questions, please contact the Permit office at permits@nnva.gov or (757) 933-2311.
Fees (nonrefundable)
Permit fees vary based on the permit type and the overall area of the proposed land-disturbing activity. Please refer to Chapter 37.1 Article VII – Soil Removal and Other Land Disturbing Activities in the Newport News Code of Ordinances for the current fee schedule.
