An Erosion and Sediment Control Plan must be submitted for review and approval when an applicant proposes to undertake any land-disturbing activity within the Chesapeake Bay Preservation Area or land-disturbing activity greater than 10,000 square feet outside the Chesapeake Bay Preservation Area. Exemptions to the above requirement are outlined in Chapter 37.1 – Stormwater Management of the Newport News Code of Ordinances.
There are a wide variety of plan requirements depending on the location and area of the proposed land-disturbing activity. Refer to Chapter 37.1 of the Newport News Code of Ordinances and Chapters 840 & 870, Agency 25, Title 9 of the Administrative Code of Virginia for requirements and mitigation measures.
Initial erosion and sediment control plan review and comment period is sixty (60) days.
Revised erosion and sediment control plan review and comment period is forty-five (45) days.
