An Erosion and Sediment Control Plan must be submitted for review and approval when an applicant proposes to undertake any land-disturbing activity within the Chesapeake Bay Preservation Area or land-disturbing activity greater than 10,000 square feet outside the Chesapeake Bay Preservation Area. Exemptions to the above requirement are outlined in Chapter 37.1 – Stormwater Management of the Newport News Code of Ordinances.
Requirements
There are a wide variety of plan requirements depending on the location and area of the proposed land-disturbing activity. Refer to Chapter 37.1 of the Newport News Code of Ordinances and Chapters 840 & 870, Agency 25, Title 9 of the Administrative Code of Virginia for requirements and mitigation measures. Review Time
- Plans determined to meet the requirements of Chapter 37.1 of the Newport News Code of Ordinances will be granted written approval within sixty (60) days of receipt of the plan.
- Plans determined to be inadequate will receive written notice of disapproval stating the reasons for the disapproval within forty-five (45) days.
- Submittal packages must be complete.
